Because we all come from different backgrounds and work across
diverse cultural and geo-political boundaries, sometimes each of us sees the world
differently. This can be good because it makes us wiser and stronger individually
and collectively, but at other times it is imperative that we see the world through
a common lens.
While our firm operates within the framework of all applicable laws, regulations and
professional standards, including the
American Bar Association (”ABA”) Model Rules of Professional Conduct,
those laws, regulations and rules do not always address all situations. So we have
adopted a universal set of values that members of our firm use to help guide their
daily actions and influence their conduct as they encounter a dynamic and ever-changing
global environment. These values are embodied in the Novus Code of Conduct.
The Novus Code of ConductTM is a globally applicable yet culturally relevant set of
principles and guidelines that are enforced on a zero-tolerance basis. Every Novus
employee receives extensive ethics training based on the Novus Code of Conduct
and is required to annually provide a certificate of compliance confirming that
the employee has read, understands, has complied, and will continue to comply,
with the provisions of the Novus Code of ConductTM.
In addition to following the ABA Model Rules of Professional Conduct, our firm is
fully compliant with the ABA’s Formal Opinion 08-451,
Lawyer’s Obligations When Outsourcing Legal and Non-legal Support Services (the “Opinion”).
For example, our three-tier conflict management process checks for conflicts at
an institutional and individual level, and requires each employee assigned to an
engagement to provide an affidavit that she or he does not have a personal conflict
with respect to each engagement on which she or he is assigned to work.
In support of the Opinion, we have prepared the Novus BlueprintTM to
facilitate and simplify a lawyer’s obligations included in the Opinion and the
ABA Model Rules of Professional Conduct. The Novus BlueprintTM addresses
important issues from the Opinion including providing the lawyer with specific
opportunities to i) verify that we are qualified to do the work, ii) direct
us while the work is being done, and iii) audit our work product to
ensure that it is done pursuant to agreed upon procedures, methodologies and
processes, and meets the specifications provided by our clients.
